Arguing federal workers should not get special treatment, Rand Paul says he does not want taxpayers subsidizing the personal health-care plans of any federal employee — including Chief Justice John Roberts — anymore.

With some in Congress arguing lawmakers and their staff should not get subsidies to cover their health insurance as President Obama’s health-care law goes into effect, the Republican senator from Kentucky told The Daily Caller on Sunday that he’s going to start pushing a constitutional amendment that goes even further.

Paul’s proposal — outlawing any special exemptions for government employees — would mean all federal workers would have to purchase health insurance on the new Obamacare exchanges instead of getting taxpayer-funded subsidies. Some critics say those subsidies amount to special treatment. The Obamacare health insurance exchange opens Oct 1.

“My amendment says basically that everybody including Justice Roberts — who seems to be such a fan of Obamacare — gets it too,” Paul told TheDC by phone on Sunday from Mackinac Island in Michigan, where he won a straw poll of potential Republican candidates for president in 2016.

“See, right now, Justice Roberts is still continuing to have federal employee health insurance subsidized by the taxpayer,” Paul said. “And if he likes Obamacare so much, I’m going to give him an amendment that gives Obamacare to Justice Roberts.”

Roberts famously voted to uphold the constitutionality of Obama’s unpopular health-care law when it went before the Supreme Court last year.

Paul’s constitutional amendment says no federal employees should get special exemptions from laws. The senator also plans to push a proposal requiring that Congress and all federal employees rely on Obamacare for their insurance.

His proposal comes after outrage from conservatives about a so-called “exemption” for members of Congress and their staff from Obamacare.

What Happens During a Government Shutdown?

If President Barack Obama “shuts down” the government by vetoing a continuing resolution (CR) that funds all government operations with the exception of Obamacare, or the Senate fails to pass such a CR, crucial services will continue without interruption. That includes all services essential for national security and public safety—such as the military and law enforcement—as well as mandatory government payments such as Social Security and veterans’ benefits.

 

The key fact, as the U.S. Department of Justice (DOJ) itself has said, is that when there is a short-term lapse in appropriations, “the federal Government will not be truly ‘shut down’…because Congress has itself provided that some activities of Government should continue.” In fact, any claims that not passing a CR will result in a “shutting down” of the government “is an entirely inaccurate description” according to the DOJ.[1]

 

Such a lapse in funding would be neither catastrophic nor unprecedented, but it would pare down government services to those most essential for “the safety of human life or the protection of property.” That would not include the hundreds of billions of dollars in the federal budget that are constantly squandered and wasted on frivolous, unnecessary, and unneeded programs.

A 1995 opinion by the DOJ’s Office of Legal Counsel over that amendment confirmed the earlier DOJ opinions, although it slightly narrowed the interpretation of “the safety of human life or the protection of property” to mean that they must be “compromised in some significant degree” by the lack of funding.[4]

 

A 2011 OMB memorandum also confirmed that the executive branch still views those DOJ opinions as establishing the guidelines for the continued operation of the government during a lapse in funding.[5]

 

The OMB refers to those government functions that can continue to operate because they meet the emergency definition as “excepted” functions. Federal employees who “are needed for the performance of those ‘excepted’ functions” can continue to be employed even in the absence of a CR or an appropriations bill.[6] In fact, the OMB says that federal employees can continue to work who are necessary not just to protect life and property but to perform activities “expressly authorized by law” or “necessarily implied by law,” an extremely broad standard.[7]

 

Many “Essential” Functions

 

As a recent report by the Congressional Research Service[8] points out, an OMB memorandum from 1981 lays out examples of the many government functions of federal agencies that may continue during a funding lapse:

 

  • National security, including the conduct of foreign relations essential to the national security or the safety of life and property;
  • Benefit payments and the performance of contact obligations under no-year or multi-year appropriations or other funds remaining available for those purposes;
  • Medical care of inpatients and emergency outpatient care and activities essential for the safe use of food, drugs, and hazardous materials;
  • Air traffic control and other transportation safety functions;
  • Border and coastal protection and surveillance;
  • Protection of federal lands, buildings, waterways, and other property of the U.S.;
  • Care of prisoners and others in federal custody;
  • Law enforcement and criminal investigations;
  • Emergency and disaster assistance;
  • Activities essential to the preservation of the money and banking system of the U.S., including borrowing and tax collection;
  • Production of power and maintenance of the power distribution system; and
  • Protection of research property.

Hundreds of Coptic Christians took to downtown Nashville, Tenn., streets this week to protest the ongoing and escalating violence their faith is facing in Egypt.

Among their chants: “Obama, Obama don’t you care? Christian blood is everywhere,” The Tennessean reported. The demonstrators, waving Egyptian flags, also called for Americans to “pray for Egypt.” And signs abounded, with messages such as: “We are against Muslim Brotherhood.”

A woman who said she has lived in the United States for 16 years expressed fear for Christians who live in Egypt, and she said the Muslim Brotherhood is to blame for the 40-plus church burnings that have been reported in recent days.

“What is terrorism,” she said in The Tennesseean article, “but being afraid to go out of your house because someone will attack you.”

Other protesters expressed the hope that the Obama administration would take a strong stand and support the interim government — not the Muslim Brotherhood — in Egypt.

Just one more reason to DEFUND Obamacare:

 

More than 1,600 new employees hired by the U.S. Department of Health and Human Resources in the aftermath of Obamacare’s passage include just two described as ‘consumer safety’ officers, but 86 tasked with ‘criminal investigating’ – indicating that the agency is building an army of detectives to sleuth out violations of a law that many in Congress who supported it still find confusing.

On the day President Obama signed the Affordable Care Act into law in 2010, HHS received authority from the Office of Personnel Management (OPM) to make as many as 1,814 new hires under an emergency ‘Direct Hiring Authority’ order.

The Obama administration ordered that employment expansion despite a government-wide hiring freeze.

 

A total of 1,684 of those positions were filled. An analysis by MailOnline shows that at 2010 federal government salary rates, the new employees’ salaries alone cost the U.S. at least $138.8 million every year.

Had the agency filled all its available jobs, that cost would have been a minimum of $159 million.

The hiring began in May 2010 and continued through June 2013, making the later hires eligible for higher salaries as a result of annual cost-of-living increases.

The difference between what HHS spent on new Obamacare-related employees and what it was authorized to spend is explained by its failure to hire most of the 261 ‘consumer safety officers’ it was authorized to bring aboard. Only two such employees were hired.

But while OPM authorized HHS Deputy Assistant Secretary for Human Resources Denise Carter — later renamed Denise Wells — to hire 50 criminal investigators, the agency increased that numberto 86 on its own.

After MailOnline lodged a Freedom Of Information Request with HHS, the agency sent aspreadsheet containing records of the positions it filled, along with the salary level for each one on the government’s ‘GS’ hiring scale.

The lowest salary on the list was for a single contracting officer at Grade 7, Step 1, an annual rate of about $42,350, including a so-called ‘differential’ payments. Those increases are given to all federal employees in order to adjust for regional cost-of-living differences.

The highest salary in 2010 dollars, including that differential payment, was about $161,450, earned by a total of 29 new employee. They include health insurance administrators, contracting officers and information technology managers.

The fleet of 86 new criminal investigators are earning a range of compensation between $51,800 and $89,350, according to the 2010 salary tables and differential payment guidelines.

Judicial Watch, a nonprofit that has told MailOnline it files ‘hundreds’ of FOIA requests, first published evidence in July of the HHS hiring binge.

‘Sounds like we now have the Obamacare police,’ said the group’s president, Tom Fitton, after MailOnline showed him the new data.

‘Given the confusion and problems of the law’s implementation, we would need a small army to police all the waste, fraud, and abuse that is already evident.’

Heritage Action for America, a conservative lobby group that opposes implementation of the Affordable Care Act, told MailOnline that it sees the hiring of criminal investigators inside HHS as a sign that its position is more and more defensible.

‘The Obama administration continues to assert near unilateral power when it comes to Obamacare,’ said Dan Holler, the group’s communications director.

‘This blatant disregard for the rule of law raises serious questions as to how these new criminal investigators will behave, what guidelines they will follow and who will provide much-needed oversight.’

Heritage Action is circulating a letter this week, penned by freshman GOP Rep. Mark Meadows, calling on 100 House Republicans to ‘take the steps necessary to defund Obamacare in its entirety, including on a year-end funding bill like a continuing resolution.’

The Department of Health and Human Services didn’t immediately respond to a request for comment, but it responded to MailOnline’s FOIA request within the number of days the statute permits.

Gallup: Unemployment Rate Jumps from 7.7% to 8.9% In 30 Days

`Outside of the federal government’s Bureau of Labor statistics, the Gallup polling organization also tracks the nation’s unemployment rate. While the BLS and Gallup findings might not always perfectly align, the trends almost always do and the small statistical differences just haven’t been worthy of note. But now Gallup is showing a sizable 30 day jump in the unemployment rate, from 7.7% on July 21 to 8.9% today.

This is an 18-month high.

At the end of July, the BLS showed a 7.4% unemployment rate, compared to Gallup’s 7.8%. Again, a difference not worthy of note. But Gallup’s upward trend to almost 9% in just the last three weeks is alarming, especially because this is not a poll with a history of wild swings due to statistical anomalies. Gallup’s sample size is a massive 30,000 adults and the rolling average is taken over a full 30 day period.

Gallup also shows an alarming increase in the number of underemployed (those with some work seeking more). During the same 30-day period, that number has jumped from 17.1% to 17.9%.

The Murfreesboro Police Department has acquired a Mine-Resistant Ambush Protected (MRAP) vehicle from the Department of Defense through the Tennessee Department of General Services Property Utilization Division, Law Enforcement Support Office. The MRAP was acquired at no cost to the City of Murfreesboro (other than standard maintenance and transportation costs from Fort Campbell, KY).

After serving the US Army in the War on Terrorism, this armored vehicle will now have a post-war life and will continue to “protect and serve” by providing the department’s Special Operations Unit (SOU) with advanced ballistic protection during high-risk situations. The vehicle is capable of providing ballistic protection for SOU officers during transport, deployment and tactical operations where hostile, life-threatening gunfire from an armed suspect poses a danger to officers or innocent citizens.

Obama Campaign Arm Rallies For Paul Ryan On Immigration

Organizing for Action, the offshoot of President Obama’s campaign committee, is now supporting Republicans — a few of them, at least.

OFA has begun demonstrating in favor of Republicans who publicly support a new path to citizenship for illegal immigrants, along with urging them to pressure their colleagues to join them. Among these Republicans is 2012 GOP vice presidential nominee Rep. Paul Ryan (R-Wis.).

On Monday the group dispatched its activists to districts held by several such Republicans: Reps. Jeff Denham (Calif.), Joe Heck (Nev.), Dave Reichert (Wash.), Aaron Schock (Ill.), Dan Webster (Fla.) and Ryan.

Few House Republicans have publicly expressed support for a path to citizenship, and the GOP-controlled House has opted to press forward with border security bills rather than comprehensive immigration reform that includes a new path to citizenship.

House leaders have said they will not vote on the comprehensive bill that passed in the Senate.

Government commissions are always set up to cover up or hide government incompetence or maliciousness once exposed. They are put together when the government fails spectacularly — as on 9/11 — and they are staffed with government insiders who can be trusted to not dig too deeply into government responsibility for its own failures or even its lawlessness. Look on the board of any government commission and you will always see the consummate insiders like Lee Hamilton.

Rarely is anyone fired for the mistakes made, ( they usually get a promotion) and the conclusions always involve setting up more reform commissions and review boards to employ the multitude of government/quasi-government revolving door beneficiaries who populate the rarefied air of posh suburban settlements like McLean and Great Falls.

Sometimes these government CYA commissions can be quite comical, as Zero Hedge’s Tyler Durden points out in a recent article. In the case of Durden’s piece, the title says it all:

President Obama announced to great Beltway fanfare late last week that he was setting up a commission to review the policies and procedures of the NSA. This was announced as part of a larger reform of NSA surveillance that the president promised, including inserting an adversarial “privacy rights” voice in the secret FISA Court proceedings.

And…who has the president tasked with setting up this NSA spying review group? The same guy who lied to Congress about NSA spying in the first place!

We can only guess who might be appointed as the FISA Court’s “privacy rights” advocate — maybe Diane Feinstein?

Attorney for Whistleblower: 400 U.S. Missiles Stolen in Benghazi

On August 12, Joe DiGenova, attorney for one of the Benghazi whistleblowers, told Washington D.C.’s WMAL that one of the reasons people have remained tight-lipped about Benghazi is because 400 U.S. missiles were “diverted to Libya” and ended up being stolen and falling into “the hands of some very ugly people.”

DiGenova represents Benghazi whistleblower Mark Thompson. He told WMAL that he “does not know whether [the missiles] were at the annex, but it is clear the annex was somehow involved in the distribution of those missiles.”

He claimed his information “comes from a former intelligence official who stayed in constant contact with people in the special ops and intelligence community.” He said the biggest concern right now is finding those missiles before they can be put to use. “They are worried, specifically according to these sources, about an attempt to shoot down an airliner,” he claimed.

On August 4, Breitbart News covered a report in The Telegraph that said 35 CIA operatives were working in Benghazi when the attack against the consulate took place. The Telegraph claimed these operatives were allegedly in an “annex near the consulate [working] on a project to supply missiles from Libyan armories to Syrian Rebels.”

Months earlier, following then-Secretary of Defense Leon Panetta’s February 7 testimony on Capitol Hill about the Benghazi attacks, Senator Rand Paul (R-KY) suggested that one of the causes behind the terrorist attack “may have been that there was a gun running operation going on in Benghazi, leaving Libya and going to Turkey and [distributing] arms to the [Syrian] rebels.”
