Opponents of a proposed new mosque in Tennessee will get to make their arguments at trial beginning today, Wednesday, April 25, 2012.
A legal battle over public notice in Rutherford County’s approval of a mosque site could affect Tennessee’s definition of a newspaper as well as guidelines for how and where governments can advertise their meetings.
In a two-day trial that starts today, plaintiffs will argue that the county government failed to provide adquate public notice of its May 2010 Rutherford County Regional Planning Commission meeting, where officials were to vote on a site plan for a new mosque for the Islamic Center of Murfreesboro.
“In this case, the issue should be whether the published notice should have included more information about the agenda, not which publication,” Frank Gibson, public policy for the Tennessee Press Association, told The DNJ this week.
The public notice published in the Murfreesboro Post did not state that mosque site approval was on the agenda because Rutherford County’s zoning laws allow places of worship to be treated the same as residential developments. No rezoning was required; therefore, no public hearing was needed before the planning commission reviewed the site plan and voted.
Chancellor Robert Corlew III has ruled already that Islam is a religion and that the ICM holds First Amendments rights to build the mosque. Work on the first phase of the building next to Grace Baptist Church on Veals Road off Bradyville Pike, just outside Murfreesboro, started in September 2011 and is nearing completion.

The ABC network is currently working on a pilot for a prime-time program called “Good Christian B-tches.”
It’s a Christian-bashing version of ABC’s current “Desperate Housewives.” The show centers on a recently divorced mother of two who moves back to the affluent neighborhood where she grew up to find herself in the whirling midst of gossip, Botox and fraud.
Disney-owned ABC has no reservations about creating hate speech against Christians, but you can be sure they would never consider a show called “Good Muslim B-tches” or “Good Jewish B-tches.”
With a title like “Good Christian B-tches,” you can imagine what kind of show it will be. Even if they change the title, the content will still mock people of faith.

Why does Obama have everything related to him sealed up and is paying attorneys Lord knows now much to keep everything related to him sealed up? Any honest answer would be he has to be covering up something. What is he covering up…..I’m not sure, but he’s hiding something. Maybe the fact that when he went to the Indonesian school and was adopted he gave up is US citizenship? And when he got it back some time in the future he was classified as a “naturalized citizen” because he can’t get the ‘natural born’ designation back? Maybe the fact that he was declared a Muslim on his school records and when he went to college here in the States he declared himself a ‘foreign student’? None of this can be denied because no one has seen the paper work to deny it. And all of it is a possibility. We also know that the Founding Fathers definition of “natural born” was that both parents were to be US citizens, not just one. Obama’s father was a dual citizen of Kenyan/British subject, that is admitted by Obama himself. So yes, like it or not, there are many legitimate reasons to still question Obama’s eligibility to hold the office of the President of the US legally.

Harry Potter actress was beaten and branded a prostitute by her brother after dating man ‘who was not a Muslim’
A Harry Potter actress fled her home after her father and brother threatened to kill her for going out with a Hindu man,(non-muslim) a court heard yesterday.
Afshan Azad, 22, who appeared in the blockbuster movies as Padma Patil, was attacked and branded a ‘slag’ when Muslim relatives found out about her boyfriend.
The actress was so scared that she escaped out of her bedroom window and later fled her home city.
Police were called and her father, Abul Azad, 54, and brother, Ashraf, 28, were arrested and charged with making threats to kill her. The actress’s brother was also charged with assault.
But Miss Azad refused to testify and yesterday failed to turn up at their trial at Manchester Crown Court.
Instead Crown prosecutors decided to accept a guilty plea to assault by her brother while both men were formally found not guilty of making threats to kill.
Her father accepted to be bound over for £500 to keep the peace for 12 months.
Miss Azad played a witch who studied at Hogwarts School in the same year as Harry Potter, played by Daniel Radcliffe.
She first appeared as her character, the identical twin sister of Parvati Patil, in Harry Potter and The Goblet Of Fire.
Richard Vardon QC, prosecuting, said the actress was ‘the victim of an unpleasant assault by her brother’ at the family home in Longsight, Manchester, in May.
He added: ‘The reason for the assault, apparently her association with a Hindu man, that apparently being disapproved of by her family who are Muslim.’
Mr Vardon said Abul Azad had been woken up by his son, Ashraf, shouting: ‘Sort out your daughter! She’s a slag.’
He went on: ‘He continued to further assault her, shouting, “Just kill her!”’
Reading from the victim’s statement, the prosecutor added: ‘My father began saying he would do it, a reference to kill her, as he did not want his sons to have her blood on their hands and he would do time for it. Then she began to feel very scared.’
Her father was said to have threatened to take her to Bangladesh and force her into an arranged marriage.
Miss Azad called the police but after making her statement, made it clear she did not want to take further action.

She fled to London and later claimed she could not understand her father’s heavy Bengali accent and may have misheard what he said.
The actress later gave a statement to the two suspects’ lawyer saying: ‘I dearly love my father and brother.
‘The proceedings have caused me no end of distress and if it goes ahead, it will make things much worse for me.’
Mr Vardon said steps had been taken to try to make sure she testified but it had not been possible to ensure she came to court voluntarily.
Her brother pleaded guilty to one count of assault and will be sentenced in January.
He was bailed on condition he lives at the family home, does not contact his sister and does not travel to London.
Judge Roger Thomas QC told him: ‘Violence in the home is all too prevalent. That sort of violence, domestic violence, can result, even for a man such as you, in imprisonment.’
The judge also directed not guilty verdicts be recorded on both defendants on the threat to kill charge.
He told Mr Azad senior: ‘You leave this court without any findings of guilt against you. Having said that, you are going to be bound over to keep the peace. You must make sure you act peaceably.
‘You have got to be of good and peaceable behaviour towards your daughter.
‘It is a way of the court trying to bring order and peace in general and, in particular, to you and your family.’
Miss Azad, who was born in Manchester and is of Bengali descent, attended Xaverian College in the city.
She had no formal acting training but won the part of Padma Patil when casting agents visited her school.
They invited her to attend auditions and, after several tests, she was chosen for the role.
Miss Azad has appeared in four of the five film adaptations of JK Rowling’s novels, most recently in Harry Potter and the Deathly Hallows.
Her voice can also be heard on the Harry Potter video game but she has not appeared in any other films.

Audacious: Ground Zero Mosque Applies for $5M Federal Grant
Developers of the controversial Park51 Islamic community center and mosque located one tenth of a mile from Ground Zero earlier this month applied for roughly $5 million in federal grant money set aside for the redevelopment of lower Manhattan after the attacks of September 11th, according to two sources with direct knowledge of the matter.
The audacious move stands to reignite the embers of a divisive debate that dominated headlines surrounding the 9th anniversary of the attacks this fall, say people vested in the issue.
The application was submitted under a “community and cultural enhancement” grant program administered by the Lower Manhattan Redevelopment Corporation (LMDC), which oversaw the $20 billion in federal aid allocated in the wake of 9/11 and is currently doling out millions in remaining taxpayer funds for community development. The redevelopment board declined to comment on the application (as did officials from Park51), citing the still ongoing and confidential process of determining the grant winners.
As I heard this story yesterday, I said to myself, these women working in the field can’t be “radical” muslims, yet they beat this woman and her children, then locked them in a room. Seems like you have to ask, who are the ‘tolerate’ ones today ? Christians or Muslims? You decide.

Muslim “Tolerance” in Pakistan — Christian woman sentenced to death for “blasphemy”
Ministry leader says Pakistan has “crossed a line” in sentencing a Christian woman to death for blasphemy.
A mother of two has become the first Christian woman in Pakistan to be sentenced to death for blasphemy.
Asia Bibi, a field labourer in her thirties, was handed the sentence by a court of sessions in Punjab province on Sunday evening.
She was found guilty of committing blasphemy against her fellow farm workers in the village of Ittanwali during a heated discussion about religion in June last year.
Some of the women workers had reportedly been pressuring Bibi to renounce her Christian faith and accept Islam. During the discussion, Bibi responded by speaking of how Jesus had died on the cross for the sins of mankind and asking the Muslim women what Muhammad had done for them.
The Muslim women took offence and began to beat Bibi and she was locked in a room by some men. According to partners of Release International, a mob reportedly formed and “violently abused” her and her children.
The charity, which supports persecuted Christians, said that blasphemy charges had been brought against Bibi because of pressure from local Muslim leaders.
Release International’s chief executive, Andy Dipper, expressed his shock at Sunday’s ruling.
“Pakistan has crossed a line in passing the death sentence on a woman for blasphemy,” he said.
In addition to the death sentence, Bibi has also been fined more than £700 – equivalent to two and a half years’ wages for an unskilled worker.
Release’s partners in Pakistan say the sentence is a crushing blow for Bibi, who had been hoping to be acquitted and return to her husband and children.
“Although Asia has great courage, her dreams of release have vanished now. Please pray for her encouragement, strength and protection.”
They are planning to visit Bibi in prison as soon as possible.
Release has launched a petition against Pakistan’s blasphemy laws. It fears that the passing of the death sentence against Bibi could set a harmful precedent in other blasphemy cases.
Another Christian woman, Martha Bibi – no relation to Asia Bibi – is on trial in Lahore for blasphemy. She was accused of committing blasphemy after a dispute with builders in Kasur who reportedly refused to return equipment belonging to her.
Mr Dipper said Pakistan’s blasphemy laws were “wide open to abuse” and that Christians and other minorities were often accused of committing blasphemy by Muslims as a “vengeful way of settling scores”.
He warned: “In effect Asia has been sentenced to death for sharing her Christian faith. In previous cases, the death sentence has not been carried out. But this could well mean a life sentence for Asia in appalling conditions on death row.”
Well here we go again….a Oklahoma voter approved ban on Sharia law in their State is put on Stay while being reviewed. If Oklahoma holds Judicial Retention elections as Iowa just held,they might want to remember the name of this Judge Vicki Miles-LaGrange if on Nov. 22 what the voters voted for is once again knocked down by this Federal judge.
Prior to the vote, ads supporting SQ 755 referenced a New Jersey case where a Muslim woman divorced her husband and filed a restraining order after he raped her. He claimed his culture and religion allowed him to have sex with his wife whenever he wanted, regardless if his wife wanted sex or not. The court agreed with this custom, rather than the law of New Jersey. This case has reverberated around the country and caused concern in some corners that similar rulings could possibly be made in states like Oklahoma..(I’ll say this….if you want to live under Sharia Law go to a Muslim country….the United States is a Christian nation and will NOT allow it over here)
As Rep. Rex Duncan, who co-sponsored the bill that would ban Shariah law, told the press today that Miles-LaGrange made some “extraordinary statements” and “her words from the bench indicated she had completely embraced the plaintiff’s arguments.” Duncan also questioned why Miles-LaGrange didn’t question Awad’s “standing,” considering he is presumably not an Oklahoma resident.

Lawsuit Filed Against Oklahoma’s Voter-Approved Ban on Islamic Shari’a Law
Oklahoma Muslim filed a federal lawsuit on Thursday to block a state constitutional amendment overwhelmingly approved by voters that would prohibit state courts from considering international law or Islamic law when deciding cases.
The measure, which got 70 percent of the vote in Tuesday’s election, was one of several on Oklahoma’s ballot that critics said pandered to conservatives and would move the state further to the right.
The lawsuit, filed in U.S. District Court in Oklahoma City, seeks a temporary retraining order and injunction to block the election results from being certified by the state Election Board on Nov. 9.
Among other things, the lawsuit alleges the ballot measure transforms Oklahoma’s Constitution into “an enduring condemnation” of Islam by singling it out for special restrictions by barring Islamic law, also known as Sharia law.
“We have a handful of politicians who have pushed an amendment onto our state ballot and then conducted a well-planned and well-funded campaign of misinformation and fear,” said Muneer Awad, who filed the suit and is executive director of the Council on American-Islamic Relations in Oklahoma. “We have certain unalienable rights, and those rights cannot be taken away from me by a political campaign.” About 20,000 and 30,000 Muslims live in Oklahoma, Awad estimated. (That’s right Mr. Awad but our rights over here will NOT to governed by Sharia Law or International Law, but by OUR Constitution!)
Legal experts have also questioned the measure.
The measure is scheduled to go into effect on Jan. 1. It’s author, Rep. Rex Duncan, R-Sand Springs, said it was not intended to attack Muslims but to prevent activist judges from relying on international law or Islamic law when ruling on legal cases.
“The threat posed by activist judges is clear,” Duncan said. “It shouldn’t matter what the law in France or any other European country is.”
Duncan described the measure as “a pre-emptive strike” in Oklahoma, where he said activist judges are not an imminent problem. But some judges elsewhere, including U.S. Supreme Court Justice Ruth Bader Ginsburg, believe courts should look to the law of other countries for guidance when deciding cases, he said.
Ginsburg told a meeting of international lawyers in Washington in July that American judges can learn from their foreign counterparts when seeking solutions to “trying questions.”
Among the 10 other questions on Tuesday’s ballot were a measure that would make English the state’s official language and another one the allows residents to “opt-out” of the new federal health care reform law. Both passed.
The questions are the product of a Republican-controlled Legislature, which circumvented Oklahoma Gov. Brad Henry — a Democrat — to take them to the ballot. Critics say Republicans were trying to beef up voter turnout among certain conservative groups by appealing to biases on immigration, Islam and the reach of Washington in a state where President Barack Obama failed to win a single county in 2008.
Republicans have denied there is a conspiracy, saying that some of the measures are designed to protect citizens from the reach of the federal government.
