Yesterday, in a closed door conference committee on the FY 2013 National Defense Authorization Act, conferees stripped out an amendment that would have prohibited the indefinite detention of American citizens and lawful permanent residents. (In violation of the Constitution’s ‘4th & 5th amendment’  I might add)

In a letter sent to both the House and Senate today, Campaign for Liberty President John Tate urged Congressmen to vote NO on the NDAA conference report.

On behalf of over half a million Campaign for Liberty grassroots activists across the country, I urge you to oppose the National Defense Authorization Act Conference Report for its deliberate insistence on allowing for the indefinite detention of American citizens.

Previously, Senators Mike Lee, Rand Paul, and others worked together to adopt an amendment to the 2013 NDAA that clearly stated the 2001 AUMF construed no authority to indefinitely detain American citizens.  That amendment was adopted last month by a vote of 67-29.

On Tuesday evening, reports surfaced that this amendment was stripped out in the conference committee and replaced with the Orwellian Section 1029, which is actually titled “Rights Unaffected.”

This egregious change is a slap in the face to civil libertarians, an affront to our Bill of Rights and due process, and just another example of Washington elites conferring unconstitutional authority on the President to carry out police state actions under the guise of “keeping us safe.”

Sixty-eight years ago this week, the Supreme Court authorized the indefinite detention of American citizens of Japanese descent during WWII.  It’s shameful our Congress is again permitting the Executive Branch to lock up American citizens and throw away the key at its whim.

Therefore, on behalf of Campaign for Liberty’s members and in defense of our fundamental rights, I urge you to stand up for the Constitution and oppose the FY 2013 NDAA Conference Report.

Today, Sen. Rand Paul issued the following statement regarding the newly released National Defense Authorization Act for 2013 (NDAA) conference report.

The amendment, introduced by Sens. Dianne Feinstein (D-Calif.) and Mike Lee (R-Utah) and which passed with a 67-29 vote on Nov. 29, was designed to guarantee Americans the right to due process and a jury trial. These are basic and core American legal privileges prescribed in our Bill of Rights, which have been observed since our nation’s founding. Removing these indefinite detention protections now means that the NDAA is in violation of the Fourth and Fifth Amendments of the Constitution.

“The decision by the NDAA conference committee, led by Sen. John McCain (R-Ariz.) to strip the National Defense Authorization Act of the amendment that protects American citizens against indefinite detention now renders the entire NDAA unconstitutional,” Sen. Paul said.

“I voted against NDAA in 2011 because it did not contain the proper constitutional protections. When my Senate colleagues voted to include those protections in the 2012 NDAA through the Feinstein-Lee Amendment last month, I supported this act,” Sen. Paul continued. “But removing those protections now takes us back to square one and does as much violence to the Constitution as last year’s NDAA. When the government can arrest suspects without a warrant, hold them without trial, deny them access to counsel or admission of bail, we have shorn the Bill of Rights of its sanctity.

“Saying that new language somehow ensures the right to habeas corpus – the right to be presented before a judge – is both questionable and not enough. Citizens must not only be formally charged but also receive jury trials and the other protections our Constitution guarantees. Habeas corpus is simply the beginning of due process. It is by no means the whole.

“Our Bill of Rights is not something that can be cherry-picked at legislators’ convenience. When I entered the United States Senate, I took an oath to uphold and defend the Constitution. It is for this reason that I will strongly oppose passage of the McCain conference report that strips the guarantee to a trial by jury.”

Faced with a Congress hostile to even slight restrictions of Second Amendment rights, the Obama administration is exploring potential changes to gun laws that can be secured strictly through executive action, administration officials say.

The Department of Justice held the first in what is expected to be a series of meetings on Tuesday afternoon with a group of stakeholders in the ongoing gun-policy debates. Before the meeting, officials said part of the discussion was expected to center around the White House’s options for shaping policy on its own or through its adjoining agencies and departments — on issues ranging from beefing up background checks to encouraging better data-sharing.

Administration officials said talk of executive orders or agency action are among a host of options that President Barack Obama and his advisers are considering. “The purpose of these discussions is to be a productive exchange of good ideas from folks across the spectrum,” one official said. “We think that’s a good place to start.”

Earlier in the day, House Democrats joined New York City Mayor Michael Bloomberg to offer another possible starting point, announcing legislation that would make fundamental changes to the nation’s gun background check system. Sponsored by Rep. Carolyn McCarthy (D-N.Y.), a longtime gun control advocate, the bill mirrors one introduced late last month by another New York Democrat, Sen. Chuck Schumer.

“Too often, any serious discussion about guns devolves into ideological arguments that have nothing to do with the real problem,” Bloomberg, a co-founder of the coalition Mayors Against Illegal Guns, told reporters at a press event outside the Capitol. “Our coalition strongly believes in the Second Amendment. We also know from experience that we can keep guns away from dangerous people without imposing burdens on law-abiding gun owners.”

For gun control advocates, however, executive action remains a more promising — albeit more limited — vehicle for reform than Congress. On Monday, The Huffington Post first reported that the Justice Department was convening meetings with groups from across the ideological spectrum in an effort to chart potential policy changes to Second Amendment law. ( I have news for these guys, to change the 2nd amendment, you MUST amend the Constitution…not pass a law banning it or make a policy change to ban it)

With President Barack Obama endorsing sweeping gun restrictions in the wake of the school shootings in Newtown, Connecticut, prices for handgun magazines are surging on EBay (EBAY) and semi-automatic rifles are sold out at many Wal-Mart Stores Inc. (WMT) locations.

Wal-Mart, the world’s largest retailer, said yesterday that it would continue to sell guns, including rifles like the one used at Newtown, where 26 people, most of them children, were killed on Dec. 14. By contrast, Dick’s Sporting Goods Inc. (DKS) suspended sales of similar guns at its more than 500 stores.

Searches of five kinds of semi-automatic rifles on Wal- Mart’s website showed them to be out of stock at stores in five states, including Pennsylvania, Kansas and Alabama. Wal-Mart doesn’t sell guns online, instead asking customers to input a zip code to see if their local store carries a specific weapon.

“We remain dedicated to the safe and responsible sale of firearms in areas of the country where they are sold,” David Tovar, a spokesman for Wal-Mart, said yesterday. He didn’t immediately respond to a request for comment on this story.

Wal-Mart has about 10 modern sporting rifles, the gun industry’s term for firearms that look like an M-16 military rifle, listed on its website. The retailer removed a description and picture of the Bushmaster AR-15, which was the model used in Newtown, after the shootings.

In 2006, Wal-Mart reduced the number and variety of guns it offered in stores, and replaced them with more upscale products such as exercise equipment. It then reintroduced firearms to many stores in April 2011 as part of strategy to add merchandise back to shelves and revive sales growth at its Wal-Mart locations in the U.S.

Gun Revenue

The move may have helped as U.S. Wal-Mart stores posted their first gain in same-store sales in more than two years in October 2011. Wal-Mart doesn’t disclose how many guns it sells, though at an analysts’ meeting in October it said gun revenue gained 76 percent in the first half of this fiscal year. The chain advertised a Sig Sauer M400 as one of its Black Friday doorbusters last month, offering the rifle for $50 off at $867.

Piers Morgan (a foreigner) is schooled by Larry Prat of Gun Owners of America. Piers shows his ignorance/ arrogance and lack of concern about the facts that show more guns equals less crime.

Piers Morgan to Larry Pratt, “You’re an unbelievably stupid man, aren’t you?”

Mr. Pratt did not take the bait, calmly continuing to elucidate his argument. “It seems to me you are morally obtuse,” he told Mr. Morgan. “You seem to prefer being a victim to being able to prevail over the criminal element. I don’t know why you want to be the criminal’s friend.”

To which Mr. Morgan responded: “What a ridiculous argument. You have absolutely no coherent argument. You don’t actually give a damn about the gun murder rate in America.” (Mr Morgan said this after completely ignoring the facts presented by Larry Pratt, obviously showing his bias.)

Piers Morgan cannot counter the arguments Pratt uses so his reaction is to call him stupid and his argument ridiculous.

Apparently, the argument that violent crime rates in areas where guns are allowed (as opposed to cities like Chicago with strict gun laws) are much lower in America than Europe is a “rather tortured argument.”

This passes for a civilized debate and “tough sledding” in Amerika. Politically correct emotions rule the day, not logic.

…Folks Steve has been saying for some time now, they are coming after our guns…your seeing the beginning of it now. If they are successsful , then we’re in deep trouble. Worse than you worse nightmare will shortly follow.

Also listen to Diane Feinstein from I think it was 1995 and what she did when threatened.She said she “made the determination that  if someone was going to take me out, I was going to take them with me”, what a hypocrite……but today she wants you to turn in your guns to the government. Yes she not only wants a ban on semi automatic weapons and large magazines, she wants everyone that has one to be forced by law to turn them in to the government. Speaking about her bill to be introduced in Congress next session she said, “It will ban the sale, the transfer, the importation and the possession, not retroactively, but prospectively,” and ban the sale of clips of more than ten bullets, Feinstein said. “The purpose of this bill is to get… weapons of war off the streets.” (And I’m sure all criminals will abide by this new law…aren’t you?)
