House Oversight Chairman Darrell Issa has warned Acting IRS chief, Danny Werfel with 5 years in prison, if he continues to obstruct the committee’s investigation. So far, only 12,000 of the 64 million pages requested have been turned over.

Werfel is on his own on this one. Neither President Obama or Eric Holder has a say in whether Werfel is prosecuted or not. The president cannot pardon Werfel. That power is only good for crimes against the federal government.

The affected chamber of the congress (in this case the House) is the judge, jury, and executioner. Once a citation would be issued for inherent contempt, the Speaker of the House must have the Sargeant in Arms of the House arrest Werfel and bring him to the floor of the House. If he is found guilty by the chamber, he is sentenced, usually by imprisonment.

The House precedent goes back to 1795 and is considered settled law, meaning the Supreme Court cannot rule to overturn the conviction. Because of the ending of the session of congress, Werfel could only be held until the end of the congress in December of 2014.

The last time the procedure was used, was in 1934, when FDR’s US Postmaster, William P. MacCracken, Jr, was sentenced to ten days for allowing documents to be torn up. McCracken appealed to SCOTUS, who ruled the Senate had not exceded it’s authority.

In his warning to Werfel, Issa wrote the following:

“Obstructing a congressional investigation is a crime.”.

“Despite your promise to cooperate fully with congressional investigations, the actions of the IRS under your leadership have made clear to the committee that the agency has no intention of complying completely or promptly with the committee’s oversight efforts.

“The systematic manner in which the IRS has attempted to delay, frustrate, impede, and obstruct the committee’s investigation raises serious concerns about your commitment to full and unfettered congressional oversight,”

The letter was cosinged by Rep. Jim Jordan, R-OH.

The IRS counters that they are moving as fast as they can and that they are not obstructing the investigation. Issa countered that even the documents that have been turned over have been dramatically redacted, far beyond any need to preserve the privacy of taxpayers.

Tennessee doesn’t need the President’s help in Creating new jobs, we’ve done pretty good on our own. I  believe we are 4th among the states in jobs created. His plan in truth will probably kill jobs, like Obamacare is doing, changing the 40 hr week to 30 hrs or less to avoid having to pay for Obamacare to the employees.

So… is that kind of like how aggressively pushing for federal, i.e. taxpayer “investment” in public-sector infrastructure projects but actively blocking private-sector ones is “not a jobs plan”? Or, maybe it’s more along the basic lines of how more Keynesian stimulus, deficit spending, increased regulation, and top-down market interference is “not a jobs plan”? Yeah, I think that’s the one.

Ah, yes — the oh-so-typical refrains of how Republicans just hate the environment and their only proffered solution is to simply slash at the government spending that our economy so obviously needs at its current and preferably an even higher level. The biggest takeaway from that perfidious little moment, however, was that the president doubled down on his claim that the Keystone XL pipeline will only create a handful of jobs — a claim that he knows full well takes some mighty conspicuous liberties with the truth.

In citing the 50-jobs number, though, the president was using the smallest possible number attached to the pipeline project. The estimate he used likely refers to a State Department finding that — after the pipeline is built — it would take roughly 50 people to maintain it.

But the comment ignores the rest of the State Department report that estimates the project would create nearly 4,000 annual construction jobs — and potentially “support” an annual 42,000 jobs.

Obama similarly ignored those findings during an interview he gave recently to The New York Times. In the interview, Obama said the project would create roughly 2,000 construction jobs and maybe 100 additional jobs after that — calling it a “blip relative to the need.”

Glenn Kessler at the Washington Post took President Obama to task for the claim as well, and I just can’t manage to get over the fact that not only has the Obama administration approved similar projects for oil-and-gas-pipelines elsewhere in the United States, but also that the president took the opportunity during his speech to also talk up natural gas as the great and cleaner-burning fuel that it is. If the president does indeed want to continue to foster the shale-gas boom and the jobs that come from domestic energy production, we’re going to need a lot more pipeline infrastructure — stat.

A newspaper editorial today greeted Barack Obama in an entirely new way as he traveled to Chattanooga, Tenn., to visit an business center and lobby for his newest strategy to try to create jobs for Americans.

“Take your jobs plan and shove it, Mr. President: Your policies have harmed Chattanooga enough,” said a commentary in the Chattanooga Times Free Press.

“Forgive us if you are not greeted with the same level of Southern hospitality that our area usually bestows on its distinguished guests. You see, we understand you are in town to share your umpteenth different job creation plan during your time in office. If it works as well as your other job creation programs, then thanks, but no thanks. We’d prefer you keep it to yourself,” the newspaper said.

“That’s because your jobs creation plans so far have included a ridiculous government spending spree and punitive tax increase on job creators that were passed, as well as a minimum wage increase that, thankfully, was not. Economists – and regular folks with a basic understanding of math – understand that these are three of the most damaging policies imaginable when a country is mired in unemployment and starving for job growth.”

FORT MEADE, Md. — A military judge Tuesday acquitted Pfc. Bradley Manning of aiding the enemy — the most serious charge the Army intelligence analyst faced for leaking hundreds of thousands of classified military reports and diplomatic cables.

Manning was convicted on all but one of the lesser charges considered by the judge, Army Col. Denise Lind, in connection with the website WikiLeaks’s receipt of the largest breach of classified material in U.S. history.

The suspense at Tuesday’s five-minute-long court martial session was limited because Manning previously pled guilty to at least portions of 10 of the 22 counts he faced. Also restraining the drama was the absence of a military jury, which the defendant waived.

ChernobylCare meltdown continues: GA insurance commissioner: will raise insurance rates up to 198%.

In a press release today, Georgia insurance commissioner Ralph T. Hudgens warns that, because of Obamacare, “Georgia insurance companies are demanding massive rate increases up to 198 percent for some individuals.” Hudgens claims this runs contrary to President Obama’s promise to “Americans that Obamacare would lower rates.”

As a result, Hudgens “announced today that he has requested an emergency delay of the filing deadline for Obamacare rates from U.S. Health and Human Services Secretary Kathleen Sebelius, and for her to show reasons why the rates submitted by Georgia health insurers are not justified by Obamacare,” his state office explains.

The commissioner of insurance office explains:

Companies opting to participate in the Exchange have provided the Department with evidence that their rates are justified and in compliance with Georgia law, citing the new Obamacare mandates as the reason.

In a letter faxed to Sebelius on Monday, Hudgens sought protection for Georgians by requesting an emergency 30 day delay of submission of his rate review to allow Department staff additional time to analyze the increases.

Hudgens adds, “I was always skeptical of Obamacare. … But I never imagined that it would lead to rates being doubled or tripled. … Increases of this magnitude will make coverage less affordable and increase the number of uninsured in Georgia.”

President Obama visited Chattanooga, TN today where he visited an Amazon distribution center to announce his new jobs plan. If Obama was expecting an army of supporters- he was surely disappointed. Organizers for the protest originally intended to hold the rally in the parking lot of the distribution center. However, after plans for the protest made headlines the area was closed to the public. Only Obama supporters were allowed in. Not only did citizens act by taking to the streets, but the entire state took action.

Chattanooga Times Free Press, a local news paper, ran a story welcoming Obama to the state. It reads:

 ”President Obama,

The Tennessee Republican Party ran television ads in the Chattanooga market  to welcome Obama. One commercial states:

“We’re succeeding in Tennessee. Not because of your liberal policies, but in spite of them.”

Tennessee’s most prominent GOP politicians were sure to stay away from Obama during his visit to the state in an attempt to distance themselves from the President. US senators Bob Corker (R) and Lamar Alexander (R- up for reelection), have been under the gun for voting in favor of the Obama’s policies more than 60% of the time and being named the most liberal GOP senators in the South. Governor Bill Haslam (R) has also been under extreme scrutiny from his constituents for not blocking all aspects of Obamacare in the state when state senators and representatives attempted to nullify it.  

Obama also spoke in favor of the Marketplace Fairness Act, which would tax sales on the internet. This is why President Obama chose to speak at the Amazon warehouse. Senator Alexander, Senator Corker and Governor Haslam are supporting the President’s push to increase taxes on the American people. In fact, Alexander co-wrote the legislation.

The event was coordinated by Matt Collins with Tennessee Campaign for Liberty. Collins says,

Working families just can’t afford another new tax. It’s sad to see Governor Haslam and Senator Alexander pushing President Obama’s agenda by supporting the Internet sales tax.”
