I read your blog post about the Sacramento Bee‘s pro-Obamacare editorial. I don’t know if you’ve seen this, but there’s a hospital in Idaho that’s trying to merge with other healthcare systems in order to consolidate its care so it could adhere to the cost-saving regulations in Obamacare. But this hospital is now being sued by the FTC, which is arguing that its attempt to merge with these other systems violates anti-trust rules. So you have an Obama agency suing a hospital for merely trying to adhere to an Obama law.

While the nation uneasily prepares for the October 1 deadline for implementation of Obamacare, a potentially fatal rift has materialized in the most unlikely place – inside the Obama Administration itself, demonstrating once again how unready the country is for this law.

…For example, the administration’s Federal Trade Commission and Justice Department are suing to block mergers among many of the nation’s hospitals– hospitals that are only trying to accommodate the changes the law promises to bring. In short they just want to stay in business under the changed environment of Obamacare… Yet, the Obama FTC is jamming on the brakes to prevent the industry from achieving this critical mass required for hospitals to run efficiently under Obamacare.

Ironically, the FTC is talking about making sure we have enough hospitals to maintain competitiveness, even as the Obamacare design is inevitably leading to fewer hospitals, doctors, pharmacies and labs.

“Take your DACA and shove it!”

Arizona Governor Jan Brewer is under fire from pro-illegal alien “rights” groups like the ACLU and La Raza for refusing drivers licenses to illegal alien “youth” granted virtual amnesty under Barack Obama’s DACA program. They have sued repeatedly to try and stop her.

But rather than back down, Brewer has doubled down.

Brewer has now directed her Department of Transportation to expand her denial of drivers licenses to ALL illegal aliens granted a reprieve from deportation by the Obama DHS or ICE, regardless of circumstances. The left has erupted in anger, absurdly claiming

After Obama created the Deferred Action for Childhood Arrivals (DACA) program by executive order last year, Gov. Brewer called it “deferred amnesty” and mandated that no one covered by it would receive a driver’s license.

Brewer’s lawyers argued that Obama’s policy isn’t federal law and the state  has the authority to distinguish between illegals with work permits who are on  the path toward permanent residency and those benefiting from Obama’s  policy. The state’s lawyers argued Arizona isn’t violating its own policy by refusing  to grant licenses to the immigrants in the program, because the youths haven’t  been granted legal protections by Congress.

This is the same argument being made by ICE agent leader Chris Crane, who is suing Obama and DHS to halt this unlawful decree.

And so far, Brewer has prevailed in court.

A Federal judge in May refused to halt the Arizona Governor’s policy. The plaintiffs have of course appealed.

 Now she has expanded this policy:

In a statement late Tuesday, Arizona’s Department of Transportation said state law precluded the department “from issuing an Arizona driver license or identification card to any applicant who cannot demonstrate, by proof satisfactory to the director and [Department of Transportation], that the applicant’s presence in the United States is authorized under federal law.”

In other words: Federal law trumps Obama’s Hispandering whims.

Not surprising, the open border nuts are apoplectic, claiming this expansion will hurt women and children victims of domestic abuse, a tiny proportion of those affected.

They are referring to the infamous “U-Visa” by which women who claim to be victims of domestic abuse or other crimes and report those crimes can be granted instant amnesty. This program is ripe with fraud. In May, a Mexican illegal alien faked an armed robbery against herself to try and get one. Illegal alien women committing marriage fraud and then falsely claiming abuse to obtain instant amnesty are common as well.

Gov. Brewer isn’t buying the crocodile tears. Obama’s actions violate Federal law, and that is enough for her to thwart his disgraceful end-runs.

We salute Gov. Brewer for standing strong where so many other states have surrendered to this lawless executive.

A parent in Towson, Md., was arrested Thursday night at a public forum after vocally expressing his concerns about the Baltimore County School District’s plan to use Common Core standards in its curriculum.

Robert Small, a concerned father, was forcefully removed from the meeting by a police officer after he interrupted Baltimore County Schools Superintendent Dallas Dance during the question-and-answer portion of the forum.

The meeting apparently didn’t allow parents to stand up and ask questions or comment. Parents and other attendants were instead asked to write their questions on a piece of paper and officials would read them.

However, Small began speaking out against the district’s use of Common Core, prompting a security guard, who was also a police officer, to approach him and order him to leave. “Let’s go!” he said sternly.

When Small didn’t immediately comply, the officer began pulling his arm and pushing him towards the exit. Some audience members gasped at the cop’s use of force.

“Don’t stand for this,” the father said as he was dragged out. “You are sitting here like cattle! Is this America?”

Small also urged other parents to demand answers on Common Core and the curriculum being used to educate their children.

As the Baltimore Sun reports, the officer then “pushed Small and then escorted him into the hall, handcuffed him and had him sit on the curb in front of the school.”

Small was charged with second-degree assault of a police officer and faces a $2,500 fine and up to 10 years in prison. He was also charged with disturbing a school operation, which carries an additional $2,500 and up to six months in jail.

Small attempted to push the officer away when he first approached him, the police report claims. Watch the video and decide for yourself if Small assaulted the officer:

If Obama allows a government shutdown because he doesn’t want to defund Obamacare, then it’s Obama’s fault, not the Republicans. Defunding one thing doesn’t automatically shutdown the government.

With Washington facing a potential government shutdown, President Obama traveled to the heartland Friday and delivered a combative rebuke of congressional Republicans for “trying to mess with me” instead of governing responsibly.

Obama railed at length against Republican lawmakers, whom he accused of “holding the economy hostage” by threatening not to fund the government and not to raise the government’s debt limit.

“Unfortunately right now, the debate going on in Congress is not meeting the test of helping middle class families,” Obama said. “They’re not focused on you. They’re focused on politics. They’re focused on trying to mess with me. They’re not focused on you.”

Obama’s rousing speech at a growing Ford manufacturing plant here on the outskirts of Kansas City amounted to an opening salvo against House Republicans heading into another intense skirmish over federal spending.

Obama spoke a couple of hours after the House passed a short-term budget bill that would pay for government operations through mid-December but withhold funding for Obama’s signature health-care law.

Obama at times sought to belittle GOP lawmakers. “The most basic constitutional duty Congress has is to pass a budget,” said the president, a former constitutional law lecturer. “That’s Congress 101.” (Oh brother, and how long has it been since Obama submitted a budget himself? Years, that’s how long!)

Updated 1:20 p.m. | Sen. Ted Cruz said Friday that Republican senators should, in effect, filibuster the House-passed continuing resolution in the Senate.

The Texas Republican is calling on his colleagues to oppose limiting debate on it, warning against what he calls procedural trickery.

“Step two is the Senate, where all accounts suggest Harry Reid plans to use procedural gimmicks to try to add funding back in for Obamacare,” Cruz said. “If Reid pursues this plan — if he insists on using a 50-vote threshold to fund Obamacare with a partisan vote of only Democrats — then I hope that every Senate Republican will stand together and oppose cloture on the bill in order to keep the House bill intact and not let Harry Reid add Obamacare funding back in.”

 

“Now is a time for party unity; Senate Republicans should stand side-by-side with courageous House Republicans,” Cruz said.

The statement underscores the unwinnable procedural hand faced by conservative senators, however. They know that Senate Majority Leader Harry Reid will move to strike out the Obamacare defunding language after getting the 60 votes needed to limit debate, but they can’t stop him without effectively endorsing a government shutdown.

The Nevada Democrat’s move is completely in keeping with long-standing Senate rules. Pending germane amendments and motions, such as a motion to strike, are allowed simple-majority votes after debate’s been limited.

“Republicans are simply postponing for a few days the inevitable choice they must face: pass a clean bill to fund the government, or force a shutdown. I have said it before but it seems to bear repeating: The Senate will not pass any bill that defunds or delays Obamacare,” Reid said in a Friday statement.

Cruz’s latest move appeared to be a reaction to criticism from House Republicans for seeming to admit defeat before they had even sent the Senate the CR.

Cruz’s statement also came shortly after the head of the Senate Conservatives Fund said likewise.

“Harry Reid needs 60 votes to approve his plan to fund Obamacare. If 41 Republicans stand strong and oppose cloture, they can defeat Reid’s plan to fund Obamacare. However, if Republicans waffle and vote for cloture, it will grease the skids for Reid’s plan to fund Obamacare. It’s pretty simple — any Republican who votes for cloture is voting to fund Obamacare,” SCF Executive Director Matt Hoskins said.

In an ironic twist, the White House is now joining health systems experts in warning that Americans who enroll in the ObamaCare insurance exchanges should expect that their personal, financial, and health information will be at risk and they could face fraud, identity theft, and even “cybersecurity threats.”

Paul Bedard at the Washington Examiner reports that with less than two weeks until the opening of the ObamaCare exchanges on October 1st, the White House is admitting the security threat is so serious that the Obama administration met late Wednesday to launch a new anti-fraud bureaucracy that will be charged with handling consumer complaints and educating Americans about the possible ObamaCare fraud and scams.

 

“Today we are sending a clear message that we will not tolerate anyone seeking to defraud consumers in the Health Insurance Marketplace,” Health and Human Services Secretary Kathleen Sebelius said after the meeting. “We have strong security safeguards in the marketplace to protect people’s personal information against fraud and we will work with our partners to aggressively prosecute bad actors, just as we have been doing in Medicare, Medicaid, and the Children’s Health Insurance Program.”

 

Bedard writes about the White House’s sudden mention of the likelihood of Americans being at risk:

 

To show just how bad the administration expects the situation to be, consider what’s being put in place to fight Obamacare fraud: a call center will have trained staff to take consumer complaints; the Obamacare website will connect consumers with the FTC’s complaint center; a “rapid response mechanism” will be established to sniff out privacy and cybersecurity threats; and a new public education campaign will be established to help consumers avoid scams.

 

CMS, the HHS agency that runs ObamaCare, also produced a new publication entitled “Protect Yourself From Fraud In The Health Insurance Marketplace.” This resource informs Americans that when they sign up for health insurance in the new exchanges, or “marketplace,” they will need some tips “to protect yourself while getting you the coverage you need.”

CMS goes on to warn Americans that the new “Navigators,” “Assisters,” and “Certified Application Counselors” are there to help but that they should not be asking for your personal information, except your Social Security number, if they help you to enroll

The Constitution guarantees the right to free speech, but don’t try to pass out copies of it at Modesto Junior College in California.

A student at the school who tried to pass out pocket-size pamphlets of the very document that memorializes our rights got shut down on Sept. 17 – a date also known as Constitution Day.

Campus authorities told 25-year-old Robert Van Tuinen, who caught the whole thing on videotape, he could only pass out the free documents at a tiny designated spot on campus, and only then if he scheduled it several days in advance.

“Watching the video is a combination of depressing and nauseating, to see what rigamarole students have to go through just to express themselves on campus,” said Robert Shibley, senior vice president of the Foundation for Individual Rights in Education (FIRE), which has taken on campus speech codes around the nation.

Van Tuinen, who said he’d read up on the school’s regulations and expected to get chased away from outside the student center, went to FIRE with the video. The foundation penned an email letter to the school’s administration on Van Tuinen’s behalf early Thursday, but Shibley said there had been no response later in the day.
