Mark Levin told WMAL yesterday morning that it’s time for some new fresh faces in the Republican leadership and it’s time for Boehner and McConnell to go. He says this leadership doesn’t know how to deal with a radical left-wing president and that unlike Reagan, who understood the existential threat from the left because he came from the left, they think the existential threat is the Tea Party.

When asked if he was going to use his powerful voice on radio to go against those like John McCain and Peter King who undercut Ted Cruz during this Obamacare fight, he replied “you can bet on it…you’re damn right I am.”

Long-time California raisin farmers Marvin and Laura Horne have been forced to experience firsthand the costs that America’s regulatory state imposes on entrepreneurs, especially innovative members of the agriculture industry.

No longer do farmers enjoy the ancient right to sell their produce and enjoy the fruits of their labor.  Indeed, Horne v. U.S. Dept. of Agriculture exemplifies the extent to which all property and business owners are made to suffer a needless, Rube Goldberg-style litigation process to vindicate their constitutional rights.

In this case, the USDA imposed on the Hornes a “marketing order” demanding that they turn over 47% of their crop without compensation.  The order—a much-criticized New Deal relic—forces raisin “handlers” to reserve a certain percentage of their crop “for the account” of the government-backed Raisin Administrative Committee, enabling the government to control the supply and price of raisins on the market.  The RAC then either sells the raisins or simply gives them away to noncompetitive markets—such as federal agencies, charities, and foreign governments—with the proceeds going toward the RAC’s administration costs.

Believing that they, as raisin “producers,” were exempt, the Hornes failed to set aside the requisite tribute during the 2002-2003 and 2003-2004 growing seasons.  The USDA disagreed with the Hornes’ interpretation of the Agricultural Marketing Agreement Act of 1937 and brought an enforcement action, seeking $438,843.53 (the approximate market value of the raisins that the Hornes allegedly owe), $202,600 in civil penalties, and $8,783.39 in unpaid assessments.  After losing in that administrative review, the Hornes brought their case to federal court, arguing that the marketing order and associated fines violated the Fifth Amendment’s Takings Clause.

After litigating the matter in both district and appellate court, the government—for the first time—alleged that the Hornes’ takings claim would not be ripe for judicial review until after the Hornes terminated the present dispute, paid the money owed, and then filed a separate suit in the Court of Federal Claims.  The U.S. Court of Appeals for the Ninth Circuit proved receptive to the government’s reversal.  Relying on Williamson County v. Hamilton Bank (1985)—the Supreme Court case that first imposed ripeness conditions on takings claims—the court ruled in a revised opinion that the Tucker Act (which relates to federal waivers of sovereign immunity) divested federal courts of jurisdiction over all takings claims until the property owner unsuccessfully sought compensation in the Court of Federal Claims.  In conflict with five other circuit courts and a Supreme Court plurality, the Ninth Circuit also concluded that the Tucker Act offered no exception for those claims challenging a taking of money, nor for those claims raised as a defense to a government-initiated action.

The ruling defies both law and common sense.  It stretches the Supreme Court’s ripeness rule beyond its moorings and it forces property owners to engage in utterly pointless, inefficient, and burdensome activities just to recover what should never have been taken in the first place.  Having filed an amicus brief that supported the Hornes’ successful petition for Supreme Court review, Cato has again joined the National Federation of Independent Business, Center for Constitutional Jurisprudence, and Reason Foundation on a new brief that urges the Court to affirm its plurality decision in Eastern Enterprises v. Apfel (1998), which held that an unjustified monetary order is inherently a taking without just compensation.  Any ruling to the contrary imposes a pointless burden on property owners, particularly when the government initiated the original proceeding.

Unbelieveable……comparing taking on the 2nd amendment to defeating the Nazis. Implying the gun lobby, pro gun people are like Hitler. Amazing.

Bob Schieffer somehow topped Chris Matthews during CBS News’s special coverage of President Obama’s gun control press conference on Wednesday, as he became the worst caricature of a foaming-at-the-mouth cheerleader for the chief executive. Schieffer lauded “one of the best speeches I’ve ever heard him [Obama] deliver“, and compared Obama’s  new gun control agenda to Lyndon Johnson’s push for civil rights legislation in the 1960s.

The CBS veteran even went so far to liken the President’s cause to the ten-year hunt for 9/11 mastermind Osama bin Laden and the difficult endeavor of winning World War II.

Mark Levin passionately defends conservatism and analyzes last night’s election in the opening monologue of the Wednesday broadcast of his nationally syndicated radio program. Here’s a partial transcript of Levin’s opening remarks:

MARK LEVIN: We conservatives, we do not accept bipartisanship in the pursuit of tyranny. Period. We will not negotiate the terms of our economic and political servitude. Period. We will not abandon our child to a dark and bleak future. We will not accept a fate that is alien to the legacy we inherited from every single future generation in this country. We will not accept social engineering by politicians and bureaucrats who treat us like lab rats, rather than self-sufficient human beings. There are those in this country who choose tyranny over liberty. They do not speak for us, 57 million of us who voted against this yesterday, and they do not get to dictate to us under our Constitution.

We are the alternative. We will resist. We’re not going to surrender to this. We will not be passive, we will not be compliant in our demise. We’re not good losers, you better believe we’re sore losers! A good loser is a loser forever. Now I hear we’re called ‘purists.’ Conservatives are called purists. The very people who keep nominating moderates, now call us purists the way the left calls us purists. And we have to hear this crap from conservatives, or pseudo-conservatives, Republicans.

Can you believe Mayor Michael Bloomberg of New York actually said this? He must be crazy! Of course in New York you have no 2nd amendment… Why doesn’t Bloomberg set the example and get rid of his armed body guards…..lead by example!

Here’s some statistics Mayor Bloomberg fogot to mention:

  • In 2008, ten times more civilians regular people were killed by cops than cops were killed by perps.
  • In 2011, 72 cops were shot and killed in the entire U.S.; in L.A. County alone, cops shot and killed 54 suspects the same year–22 percent of those people were unarmed.
  • As Scott Reeder reported at Reason this morning, “Farmers, ranchers, commercial fishermen, loggers, garbage collectors, truck drivers, construction workers, pilots, steel workers, roofers, and others are far more likely to face death on the jobs than police or firefighters, according to the U.S. Bureau of Labor Statistics.”
  • And as Choire Sicha wrote earlier this year, “2008 was the ten-year low for police officers being killed, and 2012 is, so far, year-to-date, down 49% from last year.”

Bloomberg, the commander of “the seventh biggest army in the world” went on to say that “police officers want to go home to their families. And we’re doing everything we can to make their job more difficult, but more importantly, more dangerous, by leaving guns in the hands of people who shouldn’t have them and letting people who have those guns buy things like armor piercing bullets.’’

The statistics say that the jobs of police officers are getting increasingly safer. After all, even the smallest departments now have access to battle-tested body armor, weaponry, vehicles, and unmanned drones.

Conservative radio host Mark Levin unloaded on Chris Wallace last night on his show for his awful attack on Michele Bachmann.
Levin said Michele Bachmann has a higher IQ than Obama – even before his cocaine using days.

Mark Levin said Wallace’s apology was not sincere.
It wasn’t. In fact it took 30 hours for Wallace to finally call Michele Bachmann and apologize over the phone.

Levin was not happy with the way Wallace basically called Bachmann a flake yesterday and said we must respond if we want these unfair attacks on conservatives to stop. He defended Bachmann by talking about her career and suggested that she probably has a higher IQ than Obama, even before he used cocaine. Ouch!

He goes on to say that there is no way Wallace would have referred to a liberal, especially a minority in those terms and goes even further to say that the only reason Wallace apologized is because the people rose up in anger, not because of his own sensibilities.
